ED withdraws press release against FIITJEE after Delhi High Court objection The Enforcement Directorate (ED) recently told the Delhi High Court that it will withdraw its press release alleging that entrance coaching institute FIITJEE is engaged in large-scale fraud and ₹206 crores were recovered from it as proceeds of crime. ED’s counsel made the statement before Justice Purushaindra Kumar Kaurav on May 6 during the hearing of the plea filed by FIITJEE and its founders seeking, among other reliefs, quashing of the press release published on ED's website on April 26. “Mr [Anupam S] Sharma, learned counsel for respondent- Directorate of Enforcement, on instructions, submits that the Department shall take appropriate steps to withdraw the Press Release (PR) in question from the website without being any orders on the merits or conformity of the PR with Office Memorandum, 2010 or otherwise,” the Court recorded in its order as it disposed of the plea. Notably, the High Court, in the previous hearing of the case on March 18, had made a prima facie observation that the press release cast “judgmental aspersions” on FIITJEE. Justice Kaurav had recorded that the Ministry of Home Affairs (MHA) memorandum of 2010 states that the police should not make opinionated or judgmental statements when briefing the media. On May 6, the ED said that it will withdraw the press release. The ED’s press release alleged that FIITJEE had collected ₹206 crore as proceeds of crime without rendering any service, and that incriminating documents revealed a systematic scheme to siphon funds. It was FIITJEE’s case that the press release, based on a preliminary analysis report, was issued before any show-cause notice was issued to them. Nashik TCS case: Prime accused Nida Khan arrested after weeks on run NEW DELHI: Nida Khan, an accused in the Nashik TCS case, has been taken into custody from Chhatrapati Sambhajinagar in Maharashtra, police said on Thursday. Khan was wanted in the case of alleged sexual harassment and forcible religious conversion at the Tata Consultancy Services (TCS). Officials have not yet disclosed further details regarding the allegations against Khan or the circumstances surrounding the arrest. Nida Khan, accused in TCS Nashik harassment case, arrested; what charges does she face? Nashik TCS sexual harassment and religious coercion case accused Nida Khan was held on Thursday in Chhatrapati Sambhajinagar, a police official said here. She was held with the help of Chhatrapati Sambhajinagar police and the crime branch of that city, Nashik police commissioner Sandeep Karnik informed. The Special Investigation Team (SIT) of the Nashik police is probing nine cases of molestation and harassment at the IT major's Nashik unit. It had arrested eight persons, including a female operations manager, by registering nine FIRs after allegations of exploitation, attempt of forceful conversion, hurting religious sentiments, molestation and mental harassment of female employees at the TCS unit came to light. The SIT had launched a search for Khan in different parts of Maharashtra. She is accused of targeting employees in a WhatsApp group, pressuring them to pray and eat non-vegetarian food.

Scope of legal fiction in party mergers The law has a long-standing habit of pretending: that an adopted child is the natural child of the adoptive parents, that a registered company is a person capable of suing and being sued. Sir Henry Maine, in Ancient Law (1861), called the legal fiction one of three great agencies, alongside equity and legislation, by which law adapts to changing societies, tracing it to the Roman fiction. The device has not been universally welcomed; historically, jurists worried that fictions allowed judges to make law in disguise. Lon Fuller, in his Stanford monograph Legal Fictions (1967), laid down the modern test: a fiction is honest only when its falsity is openly acknowledged; once it is “taken seriously”, once people begin to treat the pretence as fact, it loses its utility and becomes dangerous. A fiction is a tool, fashioned for a defined end, and works only within that end. On legal fiction in India In Indian constitutional law, the leading authority on this discipline is Bengal Immunity Co. Ltd. vs State of Bihar (1955), decided by a seven-judge Constitution Bench.
